TERMS AND CONDITIONS

 

Preliminary

 

1. This Offer is being run by ICICI bank  (“ICICI”) on www.flipkart.com, Flipkart mobile app and Flipkart mobile site (collectively “Platform”), which Platform is owned and operated by Flipkart Internet Private Limited (“Flipkart”, “We” or “Our”). It is open to all residents of India holding a valid and current ICICI Credit & Debit Card issued in India (“Cardholder” and “Card”, respectively).

Offer Details

1. The Offer will commence at 22nd May, 2018 (00:00 hours) and ends at 31st May, 2018 (23:59 hours) (“Offer Period”).
2. Under this Offer, Cardholders will get a Rs. 1,500 cashback on transactions made using their ICICI bank Card, during the Offer Period, on purchase of Eligible Products (defined hereunder) sold on the Platform by the seller, Truecom Retail (“Seller”). Offer is applicable only on one transaction per Card.
3. The discount will be applied to the Net Cart Value (“NCV”). NCV shall mean the total value of only the Eligible Product/s in the cart after all applicable discounts and exchange offer redemptions.
4. The Offer is applicable only on the following product i.e .  Samsung Galaxy J6 only (“Eligible Products”).
5. Cashback amount of the above Offer shall be credited in the Cardholders account by 20th October, 2018 on best effort basis.
6. The Offer is NOT applicable on transactions made using Corporate or Commercial Card.
7. The Offer is not applicable on in case partial payment is made through Flipkart Gift Card.
8. This Offer is only applicable on transactions using a Card as per the terms of this Offer and is NOT applicable on transactions made through Internet Banking.
9.  This Offer is not applicable on payments made with the Cards via the PhonePe payment container on the Platform.

 

Detailed Terms and Conditions

 

1. All Cardholders, excluding ICICI Bank Corporate Credit Card, with no outstanding of more than 30 days are eligible for this Offer.
2. The Offer is also applicable on EMI transactions on the Card
3. Add on cards will be treated as separate cards.
4. The cashback amount cannot be transferred or assigned to any other person/customer.
5.  In the event orders are fully cancelled (during & outside the Offer Periods), the corresponding cashback applicable on that order/transaction will not be granted.
6. The Offer is not applicable for Card-on-delivery transactions.
7. The Offer is not applicable on Gift Wrap or premium delivery charges.
8. ICICI Bank reserves the right to disqualify the Cardholder(s) from the benefits of the Offer, if any fraudulent activity is identified as being carried out for availing the benefits under the said Offer or otherwise by use of the Card.
9. Any person availing this Offer shall be deemed to have accepted all the detailed terms and conditions.
10. ICICI Bank and Flipkart reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these terms and conditions or to replace, wholly or in part, this offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
11. Delinquent and over-limit ICICI Bank Credit Card members will not qualify for this Offer.
12. Cardholders are not bound in any way to participate in this Offer. Any participation is voluntary and the Offer is being made purely on a best effort basis.
13. Nothing herein amounts to a commitment by ICICI Bank to conduct further, similar or other offers.
14. The above Offer is by way of a special offer for ICICI Bank Cards holders only and nothing contained herein shall prejudice or affect the terms and conditions of the card member agreement. The terms of the above schemes shall be in addition to and not in derogation of the terms contained in the card member agreement.
15. Any query regarding the Offer will be entertained only till 20th November 2018 (00:00 hours). Post such date, ICICI Bank and Flipkart will not entertain any correspondence or communication regarding this Offer from any persons.
16. ICICI Bank or Flipkart do not endorse the Eligible Products related to this Offer and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products which shall be at the sole liability to the respective sellers on the Platform.
17. Pictures of products shown in the communication sent to the customer either through mailers or advertised on the Platform, are representative only and may not bear a resemblance to the actual products.  None of the parties shall under any circumstances be responsible towards the same.
18. Products offered under this Offer are subject to availability from the respective participating merchants/sellers on the Platform and accordingly ICICI Bank or Flipkart in no circumstances shall be liable for non-availability of any of the products.
19. Under no circumstance will the offer/discount being offered under this Offer be settled with cash in lieu by ICICI Bank or by Flipkart.
20. Returned transactions, disputed or unauthorized/fraudulent transactions will not be considered for the Offer
21. ICICI Bank will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by seller(s) on products/services made available by it and the same shall be at the sole risk and consequences of such seller(s) and without reference to ICICI Bank.
22. Flipkart or the seller(s) shall not be liable for any failure by ICICI Bank to honour the transaction and for any technical issues because of which the transaction made by the Cardholder was not successful. ICICI Bank shall indemnify and hold Flipkart and seller harmless against any claims by the Cardholder for unsuccessful completion of the transaction. Further, ICICI Bank shall solely be liable to the Cardholder for wrongful remittance of the amounts by it, without any reference to Flipkart.
23.  The Cardholder shall indemnify and hold Flipkart, ICICI Bank and/ or seller(s) harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorneys fee) that may be suffered by Flipkart, ICICI Bank and/ or seller as a consequence of (i) violation of these terms and conditions, of the terms of user agreement, privacy policy (subject to change) published on the Platform, by Cardholder; (ii) violation of applicable laws by Cardholder; and (iii) any action or inaction resulting in willful misconduct or negligence on the part of the Cardholder.
24. If any Offer and/or anything to be done by ICICI or Flipkart in respect of the Offer or is prevented or delayed by causes, circumstances or events beyond the control of ICICI or Flipkart, including but not limited to, tampering, unauthorized intervention, interception, fraud, technical failures, floods, fires, accidents, earthquakes, riots, explosions, wars, hostilities, acts of government, or other causes of like or similar or other  character beyond the control of ICICI or Flipkart, then ICICI and/ or Flipkart shall not be liable for the same to the extent so prevented or delayed, and will not be liable for any consequences and on occurrence of such event, the Offer may be withdrawn at the discretion of ICICI.
25. These T&C shall be governed by the laws of India. Any disputes arising out of and in connection with this Offer shall be subject to the exclusive jurisdiction of the Courts in Bangalore only.
