FAIR & LOVELY OFFER TERMS & CONDITIONS

--These terms and conditions (“T&C”) are applicable for the Fair & Lovely Offer (“Offer”), applicable from 1st November, 2013 to 30th November, 2013.

Consumers are invited to participate in the Offer where the consumers stand the chance to win a year’s supply of Fair & Lovely, or prepaid recharge of “120 minutes of National TalkTime”/”Rs. 120 Value Top Up”/”Rs. 120 credit on their postpaid Mobile Bill” on the participants mobile number.

How to Participate in the Offer:

  • To participate in this offer, the consumer needs to give a missed call to 09987666666.
  • Participant will get an Outbound (OBD) Call and follow the instructions of the IVRS flow.
  • After answering the simple question, 15,000 consumerseveryday would win a year’s supply of Fair & Lovely. This would mean a delivery of 14 sachets (9g) of Fair & Lovely.
  • However, such consumers may also choose to accept a recharge of their pre-paid mobile number for the same amount, i.e., worth Rs. 120, instead of the above mentioned award. This shall, however, be at the sole discretion of the consumer.

Other Terms:

  • No purchase or payment of any kind is necessary to participate in this Contest. A purchase will not increase your chances of winning. Entry is open to all womenwho are 18 years or above, are legal residents of India and are not legally ineligible to participate.

  • The above Offer is sponsored by Hindustan Unilever Limited (“HUL”)

  • The period of this Offer shall be from 1st November, 2013 to 30th November, 2013

  • Participation in the contest is open to women who, on the date of entry, are legal residents of India, at least 18 (eighteen) years of age or older. Employees, officers, directors of HUL, and their immediate family members respectively, and advertising and promotion agencies, legal and financial advisors, subsidiaries and affiliate companies of HUL, and any and all other companies associated with this Offer shall also not be eligible to participate in the Offer. For purposes of this Offer, "immediate family members" means parents, spouses, children, siblings, in-laws and grandmotherswhether residents of the same household or not.

  • Entries may only be submitted by individual Participants. Group entries will not be accepted (although different individuals might have taken part in the making of an entry, only one individual may be considered to have submitted the entry). Participants of the contest may not submit entries for any person other than themselves, regardless of whether or not the participant has submitted his or her own entry.Entries not submitted in accordance with the instructions and this T&Cs, shall not be considered for the Offer and HUL shall bear no responsibility for any such entries.

  • HUL reserves the right to disqualify any participant, for any reason, in its sole discretion.

  • Neither HUL nor any of their respective parents, subsidiaries, affiliates and each of their respective officers, directors, shareholders, agents and employees, nor any agencies (collectively "Offer Entities") are responsible for incorrect or inaccurate entry of information, human error, technical malfunction, lost/delayed data transmission, lost/delayed/misdirected mail, omission, interruption, deletion, defect, line failure of any telephone or other network, computer equipment, software or any combination thereof, or for late, lost, damaged, misdirected, incorrect or incomplete entry.

  • If for any reason any aspect of this Offer is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures or any cause beyond the control of HUL, which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Offer, HUL may in its sole discretion cancel, terminate, modify or suspend this Offer, or invalidate any affected submissions.

  • For the purpose of this Offer, receipt of the entry by the Consumer shall be effectuated once the Consumer completes following the instructions of the IVRS correctly, and the entered details are received by the agency of HUL. Any entry information collected from the Offer shall be used only in a manner consistent with the consent given by the participating Consumers at the time of entry and with these Official Rules. HUL has contracted Tech Shastra, an independent third party as the Offer Administrator. The entry information is shared with the Offer Administrator for the sole purpose of the selection, notification, and the fulfillment of prizes.

  • HUL may, in its sole discretion, disqualify any submissions, and prohibit further participation in this game by, any person who tampers with or benefits from any tampering with the submission process or with the operation of this Offer or acts in violation of these T&Cs, or acts in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.

  • The determination of the Consumer, who would win the Prize mentioned above, shall be the sole discretion of HUL.

  • A total of only 5,00,000 winners will be selected during the duration of the activity. The contest shall close once 5,00,000 winners have been selected.

  • HUL reserves the right to extend or withdraw the offer at their discretion.

  • The Prize chosen by the consumer is non-transferable and offered on a no-exchange basis.

  • HUL will not enter into any correspondence, including email, with non-winning Participants. HUL reserves the right, in its sole discretion, to disqualify any individual found tampering with the entry process or entry materials. This Offer is governed by Indian law and is subject to all applicable state, and local laws. If, in HUL's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Offer, or if technical difficulties compromise the integrity of the Offer, HUL reserves the right to void suspect entries and/or votes and/or terminate the Offer and award the prizes from among all eligible entries received as of the termination date. The use of any automated launching or entry software or any other mechanical or electronic means that permits the participant to automatically enter repeatedly is prohibited. In the event of a dispute as to the identity of a Participant, the entry in question may be disqualified subject to the HUL's discretion. Should the Offer be terminated prior to the stated expiration date, HUL will endeavor to post notice of termination on the Fair & Lovely Website.

  • HUL and its related companies and agencies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this Offer or the acceptance or use of any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

  • Nothing on this Page, or on any other website of HUL, or relating to this Offer, shall be construed as conferring any license or other rights under the intellectual property or other proprietary rights of HUL or its related companies or any third party, whether by estoppels, implication or otherwise.

  • HUL and/or its agent shall be licensed to evaluate all submissions for the purposes of this Offer, including verification and as specified in these terms and conditions.

  • HUL's decisions shall be final in all matters relating to this Offer and no correspondences otherwise will be entertained.

  • HUL reserves the right to change these terms and conditions without prior notice.

  • A Participant shall be deemed to have notice of any such amendments or interpretations upon publication of the same on the Page and shall be deemed to have accepted such amendments or interpretations by virtue of his/her continued participation in this Offer. Should a Participant not wish to continue to participate in this Offer pursuant to the prevailing T&Cs as amended or interpreted, he/she may terminate participation in this Offer upon written notice to HUL.

  • It is responsibility of the participants to inform HUL of any change in the address of correspondence, for availing the prizes.

  • Apart from the entitlement to the above prize/s, the winner will have no other rights or claim against HUL.

  • HUL shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, acts of God or any other circumstances amounting to Force Majeure.

  • The prize/s will be distributed/ delivered to the winners by HUL, within 30 days of submission of all necessary documents for redemption by the winners, at the respective addresses of the winners. If the winner absent from taking delivery of the prize and fails to collect the same within 30 days from submission of redemption documents, then his prize stands forfeited

  • Participation in this Offer is at the sole discretion of the Participant.

  • By participating in this Offer, the participant agrees that HUL shall be entitled to contact the participant in the future regarding any offer, promotion, survey or such other activity by HUL, for any of its brands, without any further permission therein.

  • The data given by the participant i.e. Mobile Number, email Id and Name, will be used in strict confidence by HUL& its other partners and these will not be passed to any other uninterested party. However, such details may be used by HUL for contacting the consumer in the future, after this Offer, for promotions, surveys, offer communications, or such other reasons for any of the brands or Products marketed and / or sold by HUL.

  • HUL implements a variety of security measures to maintain the safety of the personal information entered, submitted, or accessed.

  • The participant’s information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without the participant’s consent, other than for the express purpose as mentioned above.

  • The decision of HUL as to the interpretation of any Clause shall be final and binding on the user.

  • This acceptance of the terms and conditions shall be deemed to have been given at Mumbai, Maharashtra, India and the courts in Mumbai alone will have exclusive jurisdiction to entertain any proceedings in any way relating to or concerning these terms and conditions or any rights, duties, obligations or liabilities arising there under to the exclusion of all other courts in India.

  • The Promotion is being conducted by Techshastra India Private Limited having its registered office at 217/218, T.V. Industrial Estate, Worli Mumbai - 400025, INDIA (hereinafter referred to as “Technology Partner”) on behalf of HUL.

  • Pre-paid customers of all participating telecom operators (AIRTEL, VODAFONE, IDEA, TATA CELLULAR, UNINOR, LOOP MOBILE) will get credited with 120 minutes of National Talk time. There is no value associated with this credit.

  • Pre-paid BSNL customers and other non-participating telecom operators will be credited with a value top up of Rs.120. All terms and conditions of the telecom operator Rs.120 prepaid top up recharge would apply.

  • Post-paid customer of all telecom operators will get Rs. 120 minutes credited to their bill.

  • The minutes credited for pre-paid participating telecom customers would be only towards local and national voice calls. Other services like International calls, SMS, data or subscription services etc. would not be included in these credits.

  • On successful participation, Participants shall be informed through an SMS that 120 minutes of National (Local + STD) talk time shall be credited to his account within 3 business working days.[Provided it’s an active, non-MNP prepaid mobile number (as described above) of a participating operator. For MNP, different SLA] Incase a consumer has changed his Mobile service provider under MNP (Mobile Number Portability) the minutes / value will be credited within 10 business working days. In the event of any technical issues in crediting the said minutes, customers of participating Telecom operators, may be credited with a TalkTime Value of Rs.120.

  • One(1) Mobile Number shall be able to win the prize only once.

  • On receipt of the response through the call on IVRS, the same shall be thoroughly checked and verified by the Technology Partner.

  • No entries shall be entertained after 30th November, 2013. Entries received after 30th November, 2013on the last day shall be considered as invalid and shall stand rejected.

  • The minutes will be decremented as per the customer’s tariff plan signed up with the mobile service provider. The talk time credited into a customer’s account will be subject to conditions specified by the respective telecom operator. HUL or its partners will not be responsible for the same. {The validity of the credited TalkTime and its applicability for mobile and/or landline calling OR the algorithm for decrementing Value / Minutes will be dependent on the respective telecom operator's configuration for such minutes. HUL or its partners will not be responsible for the same.}

  • The TalkTime credited into a Participant’s account is non-transferrable.

  • HUL or its partners shall not be liable for any delay in crediting of the minutes into the Participant’s account.

  • The time required for credit of talk-time for all non-Mobile number portability (MNP) requests received from mobile numbers of participating telecom operators will be 3 business working days post receipt of such request from the customer. Time Taken for credit of talk-time for all Mobile Number which have Ported cases (customer has ported out of the original service provider's network) will be 10 days from the date of receipt of the request, provided the new telecom operator is part of the participating telecom operator.

  • HUL shall not be responsible for downtime on services rendered by the Telecom operators / provider that may occur for any reason whatsoever including without limitation due to decisions and / or changes in regulations that are carried out by TRAI, DoT or any other regulatory body.

  • Participation in the contest shall be voluntary and at the sole discretion of the Participant. By participating in this campaign, the Participant fully and unconditionally agrees to and accepts these Terms and Conditions available on www.fairandlovely.in ("Programme Website") as well as the decisions of HUL and/or the MOBILE Partner and/or the On-Ground Technology Partner, which are final and binding in all matters related to the Programme.

  • HUL or its technology partner shall not be responsible if for some reason the Participant is unable to call to the above number.

  • Standard charges shall apply for calling the specified number. Participants shall be charged as per his/her plan. Basis the tariff plan of each Participant with their respective Telecom operator the Participant will be charged for each SMS that is sent from their respective mobile phone

  • HUL or its Technology Partner shall not be liable for any loss or damage due to act of God, governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any other such loss.

  • HUL or its Technology Partner shall not be liable for any loss of offer due to incorrect mobile number of user or any other information provided by the user.

  • HUL reserves the right to alter, modify or change any terms and conditions herein or modify/change, discontinue, terminate, withdraw the campaign at any time during the Campaign Period at its sole discretion without prior notice or assigning any reason.

SMS & Voice services

It is automatically agreed and accepted that:

  • As per TRAI regulation, there will be no delivery of any messages to the Participants who are registered with TRAI NCCP/ DND (Do-Not-Disturb) under - National Do Not Call Registry, except under following condition:
    • Information regarding the redemption of their UCNs as and when initiated by the customer;

    • Consumer shall be sent service related SMS’s like information regarding status of complaints/ queries/ requests made;

    • Customer opts in to receive future offers from HUL at the end of the IVRS;

    • TechShastra is not responsible for any complaints arising on account of the above from users participating in this campaign.

  • The functioning and operation of the SMS Service is dependent on the Telecom Operators’ Network for which we shall not be responsible in the event of delay / failure of Telecom Operators network transmission or failure of message transmission or for any other reasons whatsoever

  • We are not responsible for any failure to send FREE SMS under any circumstances. Failure to send SMS may arise due to multiple reasons ranging from mobile network, out of coverage area, and due to network congestion

  • We do not charge you to access these services on your Mobile handset. However, your Telecom operator’s normal messaging, VAS Messaging, VAS download rates, data access/usage charges and other rates and fees will be applicable as per the prevailing rates and as per the subsequent changes in the charges as the case may be. In addition, downloading, installing, or using certain Mobile Services may be prohibited or restricted by your carrier, and not all Mobile services may work with all carriers or devices.

  • HUL has the right to contact the Participants at any reasonable time after this campaign and use Video’s/Photo’s of the Participants for campaign or promotion of Taaza without any further permissions.
