1. 'Ek Crore Ka Shortcut' is brought to you by Pepsi Foods Pvt. Ltd. ('Organizer').2. This Promotion is valid from September 15, 2011 till October 30, 2011 in India on purchase of 2l/2.25l PET bottles of Pepsi, Mountain Dew, 7UP or Mirinda and 1.2 l bottle of Slice only ('Promotion Period'). Promotion not valid in the state of Tamil Nadu. 3. Promotion is open to all Indian residents above 18 years of age except employees and family members of the Organizers, its associate companies, it's advertising and promotional agencies, its auditors and their associate companies. 4. Promotion is being conducted under the supervision of independent firm of Chartered Accountants ('Auditors'). 5. Organizer reserves the right, at any time, to verify the validity of entries and participants (including a participant's identity, age and place of residence) and to disqualify any participant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. 6. Participation is optional. Products without the Promotion are also available. 7. On purchase of the above mentioned Products during the Promotion Period, look under the label and you could win any one of the following prizes: (i) Rs. 10000000 (Rs. One Crore) (Number of prize – 1) (ii) Opportunity to Watch Kaun Banega Crorepati live on the sets of Sony (Number of prizes -45) (iii) Gold Coins 10gms each (Number of prizes : - 3 everyday during the Promotion Period) (iv) Silver Coins 50gms each (Number of prizes : - 12 everyday during the Promotion Period) (v) Free Ringtone (Minimum Guaranteed Prize) 8. Participant is required to answer the simple question on the back of the label and SMS the answer to 9718852525 along with the unique code. 9. The cost of sending an SMS is as per the applicable tariff of the service provider. It is recommended that consumers check with their individual service provider for the tariff rates. 10. Entries are deemed to be submitted at the time of receipt of the same into the Organizer's database, and not at the time of transmission by the Participant. 11. A lucky draw through software will decide the daily winners which will be randomly selected. 12. For prizes in category 8 (i): (i) All participants who have sent in the correct answers during the Promotion Period with the unique codes will be eligible for the lucky draw. (ii) The lucky draw will be held using the automated software after 00:00am on November 1, 2011. (iii) The winner will be contacted by the representatives of the Organizer on the number from which the entry was sent. The winner would be contacted thrice over a period of 24 hrs. In case the winner is not reachable or the prize cannot be redeemed by him for any reason whatsoever, the organizer will reserve the right to pass on the prize to another participant. (iv) The prize will be given to the winner on the show of Kaun Banega Crorepati. The choice of the date, the person who would hand over the prize and when the prize will be handed over will be at the sole discretion of the Organizer. (v) In case there is a time lag between the declaration of the winner and actual handing over of the prize to him, the information about the win would be kept confidential and the winner would sign the requisite undertakings/documents to ensure the same. (vi) In the event of a death of the prize winner, no claim from the nominees or legal heirs of the prize winner will be entertained for receiving the prize. (vii) All costs relating to travel to Mumbai from the winner's place of residence, boarding and lodging (Organizer's choice of hotel shall be final) for 1 day and 1 night, food, for the winner will be borne by the Organizer. All other expenses not expressly included above will not be borne by the Organizer or any other agency on Organizer's behalf, and will be the sole responsibility of the prize winner. (viii) All taxes/levies and charges on the prize in will be the responsibility of the winner. Taxes as applicable will be deducted at the source for the prizes. 13. For prizes in category 8 (ii): (i) The prize will entitle the winner to be a part of the live audience at the show Kaun Banega Crorepati. This does not entitle him to be an actual participant on the show or to meet any celebrity. (ii) All Entries received after 00:00 am every day shall be judged for the prize for the following day. (iii) The Prize for the first day will be announced after 3 days of the close of entries for that particular day. The Winners name will be put up on the website of the Organizer. The winners will also be contacted by the Organizers and the process of redemption will be explained to them. (iv) Dates when the winner may redeem his/her prize are entirely at the discretion of the Organizer. If any Winner fails to take the trip when specified by the Organizer the prize will be forfeited in its entirety. (v) All costs relating to travel to Mumbai from the winner's place of residence, boarding and lodging (Organizer's choice of hotel shall be final) for 1 day and 1 night, food, for the winner will be borne by the Organizer. All other expenses not expressly included above will not be borne by the Organizer or any other agency on Organizer's behalf, and will be the sole responsibility of the prize winner. (vi) Organizers shall not be liable for any cancellations and/or delays in the train/flights/cars arranged for the Winner due to any reason including but not limited to force majeure, logistical problems at the airports/railway stations/roads etc and the Winner shall not have any claim against Organizer for the same and shall be deemed to have availed of his/her prize. Organizer shall not be responsible for any such eventuality and the Winner undertakes not to claim any compensation from the Organizer for the same. (vii) Organizers shall not be responsible for any loss, injury or any other liability arising out of this trip for which the winners will be required to sign an indemnity in favour of the Organizers. 14. For prizes in category 8(iii) and 8(iv), the prizes would come with a certificate from the manufacturer. Organizer would not be responsible for the purity of gold/silver or manufacturing defects in the gold/silver. The manufacturer would continue to be liable for the same. 15. The prizes in category 8(iii) and 8 (iv) may carry the logo or other information of the organizer. 16. Each winner (except for category 8(i) )will be contacted 4 times over a period of 48 hours to inform them of the win. In the event that the winner is not contacted in the 4 tries the Organizer shall (at its sole discretion) be at a liberty to pass on the prize to the next winner. 17. The picture of prizes depicted on the press ads/posters/ TVC's etc. are only representative and the actual prizes may vary from the depictions, also the programme does not constitute an endorsement or recommendation of the products or services being offered as prizes. 18. SMS sent to any other number except mentioned above shall not be considered for the prize. 19. For all prizes the winner should be above 18 years of age. 20. Participant claiming prizes will have to surrender their labels to the representative of the Organizers against a receipt for the purpose of verification by the Auditors. Award of Prizes is subject to the verification of the prize winning labels and other documents by the Auditors. 21. Surrender of label is a mandatory condition to claim the prize. The participants are requested to preserve the labels that form the basis of their claims. 22. Besides the winning label, winners would be asked to give documentary evidence of ID & address, proof of age, copy of PAN card / form 60 or any other document that the organizers might require to process his claim, 23. One mobile number shall entitle the Participant to one prize only. i.e one participant can win only one prize from all the prizes. 24. Decision of Organizer's and Auditors will be final and binding with regard to promotion and prizes and no correspondence will be entertained in this regard. 25. At the Organizer's request, winners must participate in all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Organizer using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in promotional material or in any media for an unlimited period without remuneration for the purpose of promoting this Programme (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Organizer. 26. The Organizer's decision is final and no correspondence will be entered into in relation to any decision taken by the Organizer. 27. As a condition of accepting the prize, winners may be required to sign any legal documentation as and in the form required by the Organizer and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form. 28. The Organizer accepts no responsibility for any tax implications that may arise from the prize winnings. Winners will have to bear incidental costs, if any, that may arise for redemption of the prize. 29. Organizer shall not be responsible for any loss, injury or any other liability arising out of the Programme or due to participation by any person in the Programme. 30. Organizer shall not be liable for any loss or damage due to Act of God, Governmental actions, other force majeure circumstances and shall not be liable to pay any amount as compensation or otherwise for any such loss. 31. All disputes relating to this Programme shall be subject to the exclusive jurisdiction of Courts at New Delhi only.
